1. Acceptance of Terms

By accessing or using any service, platform, or website operated by Digitals AI and ML Platforms Private Limited ("Digitals AI", "Company", "we", "us"), incorporated in India, you agree to be bound by these Terms of Service. If you do not agree, you must not access or use our services.

2. Description of Services

Digitals AI provides enterprise AI and machine learning platform services, including but not limited to: AI Command Center, Data Intelligence Studio, AI Agents Platform, and Campaign Intelligence System. Services may be delivered via cloud, on-premise, or hybrid deployment models depending on your agreement with us.

3. Eligibility

Our services are intended for use by businesses and organizations. By using our services, you represent that you are authorized to enter into this agreement on behalf of your organization, and that your organization meets any applicable legal requirements to use AI-based services in your jurisdiction.

4. Accounts and Access

Access to certain services requires account registration. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at info@digitalsusa.com if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of applicable regulations.
• Attempt to gain unauthorized access to any part of our systems or infrastructure.
• Reverse engineer, decompile, or disassemble any component of our platform.
• Use our services to develop competing AI platforms or services.
• Transmit malicious code, viruses, or any disruptive content through our platform.

6. Intellectual Property

All platform technology, software, documentation, and content are the exclusive intellectual property of Digitals AI and ML Platforms Private Limited or its licensors. Nothing in these terms grants you any ownership rights. You retain full ownership of data you input into our systems.

7. Data and Privacy

Your use of our services is also governed by our Privacy Policy. For enterprise deployments, data processing terms are governed by a Data Processing Agreement (DPA) executed as part of your service contract.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We reserve the right to suspend or discontinue services with reasonable notice for maintenance, security, or legal reasons. Uptime commitments for enterprise customers are governed by your Service Level Agreement (SLA).

9. Limitation of Liability

To the maximum extent permitted by applicable law, Digitals AI shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total aggregate liability shall not exceed the amounts paid by you to us in the twelve months preceding the claim.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India, unless otherwise agreed in writing.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes via email or a notice on our website. Continued use of our services after such notice constitutes acceptance of the revised Terms.
